1. Acceptance of Terms
By accessing or using the Crusto platform at crusto.app (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use the Service. These terms apply to all users, including account holders, team members, and visitors.
2. Service Description
Crusto provides a cloud-based pizzeria management platform designed to help independent pizzeria operators manage orders, menus, inventory, staffing, and business analytics. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Account Registration & Responsibility
To access certain features, you must create an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorised access or security breach.
We reserve the right to suspend or terminate accounts that violate these terms or are used for fraudulent or unlawful purposes.
4. Acceptable Use
You agree to use the Service only for lawful business purposes. You must not:
- Use the Service to transmit harmful, offensive, or illegal content.
- Attempt to gain unauthorised access to any part of the platform or its infrastructure.
- Reverse-engineer, decompile, or disassemble any aspect of the Service.
- Use automated tools (bots, scrapers) to access the Service without our written consent.
- Interfere with the performance, availability, or integrity of the platform.
5. Billing, Payments & Plans
Plan pricing and inclusions are described on our pricing page. By subscribing to a paid plan, you agree to the following:
- Fees are billed in advance on a recurring basis (monthly or annually) as selected at checkout.
- All fees are quoted in United States Dollars (USD), unless otherwise stated or an alternative currency is specified at the time of purchase.
- You authorise us to charge your nominated payment method for applicable fees.
- We may update pricing with at least 30 days' written notice. Continued use after the price change takes effect constitutes acceptance.
- Refunds are handled on a case-by-case basis at our discretion.
6. Intellectual Property
All content, features, and functionality of the Crusto platform — including but not limited to text, graphics, logos, user interface (UI) designs, user experience (UX) flows, visual layouts, wireframes, interaction patterns, software source code, compiled code, algorithms, business logic, concepts, methodologies, know-how, trade secrets, data models, APIs, documentation, and overall look and feel — are the exclusive property of Crusto and are protected by applicable Sri Lankan and international intellectual property laws, including copyright, trademark, patent, and trade secret protections.
You may not reproduce, distribute, modify, adapt, publicly display, or create derivative works from any part of the Service without prior written consent from Crusto. Unauthorised use of any Crusto intellectual property may result in legal action.
7. Prohibition on AI-Assisted Replication
You are strictly prohibited from using artificial intelligence (AI), machine learning, large language models, generative AI tools, or any automated technology to:
- Analyse, reverse-engineer, or extract the design, functionality, concepts, or architecture of the Crusto platform or any part thereof.
- Generate, recreate, or replicate any software, user interface, user experience, feature, workflow, or business logic that is substantially similar to the Service.
- Train AI models or datasets using content, code, designs, or data derived from or inspired by the Crusto platform.
- Produce competing or derivative products, services, or prototypes based on the Service, whether in whole or in part.
This prohibition applies regardless of whether the AI-generated output is identical to or merely substantially similar to any aspect of the Crusto platform. Any breach of this clause shall constitute a material violation of these Terms & Conditions and may result in immediate account termination, legal proceedings, and claims for damages.
8. Your Data & Content
You retain ownership of any data, content, or materials you upload to the platform ("Your Content"). By using the Service, you grant us a limited, non-exclusive licence to use Your Content solely for the purpose of providing and improving the Service. We will not share Your Content with third parties except as described in our Privacy Policy.
9. Availability & Uptime
We strive to maintain high availability of the platform but do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to scheduled maintenance, software updates, or circumstances beyond our control. We will endeavour to provide advance notice of planned downtime where possible.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
- Our total liability for any claim related to the Service is limited to the amount you paid to us in the 12 months preceding the claim.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable consumer protection laws.
11. Indemnification
You agree to indemnify and hold harmless Crusto, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the Service, violation of these terms, or infringement of any third-party rights.
12. Termination
Either party may terminate the agreement at any time. You may cancel your account by contacting us at contact@crusto.app. We may suspend or terminate your account if you breach these terms. Upon termination, your right to access the Service ceases immediately, and we may delete your account data after a reasonable retention period.
13. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
14. Changes to These Terms
We may update these Terms & Conditions from time to time. When material changes are made, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or a notice on the platform. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.
